The Fourth Issue of the Ateneo Law Journal’s 65th Volume is now available online.
The Issue, with the theme “Local Government and the Law,” examines the Local Government Code (LGC) after its groundbreaking enactment in 1991. The Articles and Notes review and address pertinent jurisprudence that underscores the insufficiencies in the Code which have surfaced in the last three decades.
Included in the Issue is the Article by Atty. Antonio G.M. La Viña and Mr. Jayvy R. Gamboa entitled, “Decentralization of What? Thoughts on a Legally Permissible and Necessary Decentralization of Power to Local Government Units” which revisits the role of the LGU during the COVID-19 pandemic, using the principle of subsidiarity as an alternative guiding precept.
The Issue likewise highlights the gaps in the law and its implementation, including the LCG’s minimum age requirement for mayors and vice-mayors, as well as the provisions on real property taxation, as respectively illuminated in the Articles “The Accidental Local Chief Executive: Examining Legal and Policy Tensions Arising from Improper Succession in Cities and Municipalities” by Mr. Juan Paolo M. Artiaga and Atty. Victor Enrique G. Bolinao, and “Thriving at Thirty? Assessing Real Property Taxation on the Thirthieth Year of the Local Government Code of 1991” by Atty. Mely Ann Emerie A. Cristobal.
