The Second Issue of the Ateneo Law Journal’s 66th Volume is now available online.
Centered on the theme, “A Representative Government Under the Rule of Law,” the Second Issue of the 66th Volume examines the various facets of a constitutional democracy, such as, among others, the scope of the citizenry’s power at the forefront of addressing critical social, economic, and political issues.
Among the Articles included is "The Wisdom Among Us: A Critical Examination of the Political Wisdom of the Filipino People and the Theory of Popular Sovereignty in Philippine Democracy," by Atty. Eugene T. Kaw, which offers an extensive discussion of the historical development of the theory of popular sovereignty and the philosophy behind the plurality system in elections.
Atty. Anna Lea Barron, in "Freedom of Expression, Fake News, and the Elections: How Expression Is Limited or Amplified in the Democratic Elections in the Philippines,” casts light on the present state of democratic elections in the country, scrutinizing the interplay between free expression and fake news during the election season.
Atty. Ruby Roselle L. Tugade closes the Issue with “In Duterte’s Perfect Storm: A Rule of Law Dispatch in the Dire Days of Philippine Liberal Democracy,” which analyzes how the shortcomings of liberal democracy post-EDSA and gaps in the country’s executive and legal institutions have accommodated an iron-fisted administration marred by a bloody “war on drugs,” fake news, and clampdowns on political dissent.
The Issue features a collection of works that probe into the strength and vulnerabilities of the Philippines’ democratic institutions, highlighting not only the true extent of the country’s constitutional democracy, but also its limitations under the rule of law.
