The Third Issue of the Ateneo Law Journal’s 67th Volume is now available online.
This Issue explores the constant evolution of the legal landscape resulting from rapid technological developments, changes in societal values, and economic progress. Although full of promise, there arises diverse legal issues confronting recent times.
In the Article entitled “This Is Not a Sponsored Post: Misuse of Data and Its Role in Creating Internet Hegemonies” by Atty. Maria Carmela B. Suarez, anti-competitive and antitrust policies are examined through the lens of the Philippine Competition Act. This Article emphasizes the pressing need to protect user privacy and consumer choice.
Dean Cesar L. Villanueva, Atty. Lily K. Gruba, Atty. Angelo Patrick F. Advincula, and Atty. Joyce Ann C. Wong provided a comprehensive analysis on the profound implications of climate change in their Article entitled “Directors’ Duties & Responsibilities and Disclosure Obligations Under Philippine Laws on Climate Change Risks.” The analysis underscores the need for sustainable business practices and emphasizes directors' duty to diligently identify and address climate risks. This approach ensures the protection of the environment while also safeguarding the company's interests.
In the Article entitled “The Viability of Investment Mediation in the Philippines”, Atty. Angela Ray T. Abala offers an alternative and cost-efficient method of international investment arbitration through mediation. This proposed framework gives rise to a new approach in examining disputes arising from bilateral investment treaties.
This Issue aims to address the gaps and examine the potential areas for advancement as seen in recent jurisprudence, energy regulations, investment mediation, and anti-competitive policies all to promote a healthily competitive economy for the benefit of the public.
